Rules for using Desio

These Terms govern the Desio website, the HabiVue iOS app, AI-assisted design tools, accounts, and paid memberships. Desio is the web experience for HabiVue. One account gives you access on the web and in the HabiVue app. The service is operated by VRCFORGE STUDIOS LTD, company number 15117291, with registered office at 18 Central Park Avenue, Dagenham, England, RM10 7DA. Our official registration is available on Companies House.

1. The service

Desio creates AI-assisted visual concepts for home-design exploration. Concepts are for inspiration and early planning, not architectural, structural, engineering, electrical, fire-safety, building-code, contractor, or other professional advice.

AI output may be incomplete, inaccurate, impractical, or different from a real room. Before spending money or starting work, you are responsible for checking measurements, colours, materials, availability, permissions, compatibility, and safety with qualified professionals where appropriate.

2. Eligibility and accounts

You must be legally able to enter into these Terms. You must provide accurate information, protect your login credentials, and promptly tell us if you suspect unauthorised account access. You are responsible for activity performed through your account unless applicable law provides otherwise.

3. Your content and privacy

You retain your rights in room photos, prompts, and other material you provide. You grant us a non-exclusive, worldwide licence to host, copy, process, adapt, and display that material only as reasonably needed to provide, secure, diagnose, improve, and support Desio, subject to our Privacy Policy.

You must own uploaded content or have permission to use it. Do not upload unlawful material, third-party private information without permission, or content that infringes intellectual-property, confidentiality, or privacy rights.

4. Generated concepts

Subject to applicable law and third-party rights, you may use concepts generated for your account for personal design projects. AI systems can produce similar results for different users, so outputs are not guaranteed to be unique, exclusive, accurate, or eligible for intellectual-property protection.

5. Acceptable use

You may not interfere with the service, bypass limits, probe security without written permission, introduce malicious code, scrape at scale, reverse engineer protected parts except where law expressly permits it, impersonate another person, use another person's account, or use Desio for unlawful, harmful, deceptive, or infringing activity.

6. Trials, subscriptions, and renewal

The website may offer a three-day trial followed by Studio Flex at the displayed localised price every two weeks. A monthly plan may also be offered at the displayed localised price. The trial length, price, currency, tax treatment, and billing frequency presented immediately before confirmation control your purchase.

Unless cancelled before the relevant renewal, paid memberships renew automatically and the purchase channel may charge the payment method provided. Website memberships and App Store subscriptions are separate purchase channels and may have different prices, controls, and billing records.

7. Payment and taxes

Website purchases are processed securely by the payment provider presented during checkout. The provider may process the displayed initial and recurring charges, perform required payment authentication, calculate applicable transaction taxes, and supply the payment receipt. Any provider terms shown before confirmation or on the receipt also apply to that transaction. You are responsible for keeping payment information current. A failed or reversed payment may result in restricted paid access.

8. Cancellation and refunds

You may cancel a website trial or subscription at any time directly from the subscription controls inside the HabiVue app. You can also use the subscription cancellation page with the checkout email and last four card digits for automatic cancellation of matching website subscriptions. The page confirms completed cancellation; if your details cannot be verified, contact support. Confirmed cancellation stops future billing and payment retries; access may end immediately. A payment already submitted before cancellation may still finish processing. Deleting the app or account, removing a payment method, or not using the service does not cancel a subscription. Cancelling stops future billing but does not automatically reverse an earlier charge. Contact us first for a delivery, access, billing, or technical problem so we can investigate and, where appropriate, process or support the request through the payment channel used for the purchase. See our Refund Policy. Nothing in these Terms limits refund, repair, repeat-performance, cancellation, cooling-off, or other rights that cannot lawfully be excluded.

Where the law permits immediate supply of digital content or services to affect a cooling-off right, we rely on that only when the legally required express request and acknowledgement have been obtained. Purchases made through Apple are cancelled and refunded through Apple under its rules and applicable law.

9. Availability and changes

We may update, add, remove, or temporarily pause features for maintenance, security, legal, or operational reasons. We do not promise uninterrupted availability or that every concept will meet subjective expectations. If a material change adversely affects a paid service, we will provide any notice, remedy, cancellation right, or refund required by law.

10. Suspension and termination

We may restrict or end access where reasonably necessary to protect users or the service, investigate abuse, comply with law, address non-payment, or respond to a material breach. Where appropriate, we will provide notice and a reasonable opportunity to remedy the issue. Ending access does not remove obligations or rights that arose earlier.

11. Intellectual property

Except for your content and rights expressly granted to you, Desio, its software, branding, design, and service materials belong to us or our licensors. These Terms grant a personal, limited, non-exclusive, non-transferable right to use the service while your access remains valid.

12. Responsibility and mandatory rights

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer remedy that law does not permit us to exclude.

If you use Desio as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses arising from consumer use, or for design and construction decisions made without independently checking an AI concept. If you use the service for business purposes, any additional limitations permitted by law may apply.

13. Third-party services

Desio may depend on payment providers, app stores, hosting, identity, email, and other third-party services. Their own terms apply to their services. We are not responsible for third-party services beyond the responsibility imposed on us by applicable law.

14. Changes to these Terms

We may update these Terms to reflect changes to the service, law, security, or business operations. We will update the date above and give additional notice of material changes where required. Changes do not retroactively remove rights that have already arisen.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law of the country where you habitually live. Please contact us first so we can try to resolve a concern promptly.
